Niniejsza praca jest ważna, gdyż że ludzie nie wiedzą jakie problemy wiążą się z dzieciobójstwem, jaka kara przewidziana jest za to przestępstwo, jak do tego zagadnienia podchodził i podchodzi ustawodawca, medycyna oraz socjologia. Celem niniejszej pracy jest analiza problemów związanych z ratio legis art. 149 kk. Kolejne jej części dotyczą ogólnej charakterystyki historii dzieciobójstwa, analizy dogmatyczno- prawnej przestępstwa dzieciobójstw w polskim kodeksie karnym (na tle Konstytucji), ogólnej analizy ratio legis i funkcji jakie spełnia, różnych modelów uzasadnień aktów prawa, w tym kodeksu karnego (aksjologicznego oraz legalistycznego).
This work is important because people do not know what problems are related to infanticide, what punishment is given for the offense, how the legislator, medicine and sociology approached and approached this issue. The aim of this paper is to analyze the problems related to the ratio legis art. 149 kk. The following sections cover the general characteristics of the history of infanticide, the dogmatic and legal analysis of the crime of infanticide in the Polish Penal Code (in the context of the Constitution), the general analysis of the ratio of legends and functions.
