Administrative proceeding of changing name and surname

Praca poświęcona została postępowaniu administracyjnemu w sprawie zmiany imienia i nazwiska. W pierwszej części pracy nakreślony zostaje rys historyczny oraz geneza instytucji imion i nazwisk, a także jego ochrona jako dobra osobistego. W dalszej kolejności przedstawione zostały podmioty uczestniczące w wyżej wymienionym postępowaniu . Następnie bardzo szczegółowo opisane zostały poszczególne fazy postępowania administracyjnego w sprawie zmiany imienia i nazwiska na podstawie Ustawy o zmianie imienia i nazwiska oraz Kodeksu postępowania administracyjnego, oraz charakterystyka decyzji administracyjnej ze wskazaniem jej obowiązkowych elementów. Ostatni rozdział porusza zagadnienie instytucji świadka koronnego.

Main topic of this thesis is the process in which citizen can change name and surname under the circumstances regulated by polish administrative law. First chapter contains short historical introduction as well as genesis description of the legal institution of name and surname, and their protection as personal goods. Following chapter contains information about all subjects that are included in the process mentioned. Next chapter does include detailed descriptions of every particular phase of administrative proceeding regarding change of name and/or surname accordingly to the requirements applied by ‘Act on the change of name and surname’ and ‘Code of Administrative Procedure’ , and the characterization of an administrative decision with indication to its mandatory parts. The last part of thesis describes instance of crown witness in polish law in regards of its identity protection.
