Artykuł przedstawia i analizuje zagadnienie użyteczności filozofii prawa międzynarodowego dla prawników analizujących problemy związane z używaniem siły zbrojnej z motywów humanitarnych. Autor odrzuca te filozofie prawa, które akceptują dictum "nielegalne, lecz legitymizowane", ponieważ uważa nie dictum za wewnętrznie sprzeczne i, nadto, osłabiające pewność prawa w porządku prawnym. Jednocześnie, autor opowiada się za budowaniem filozofii prawa międzynarodowego z wewnętrznej perspektywy, to znaczy filozofii uwzględniającej dogmatykę prawa międzynarodowego i jego teorię.
The paper presents the basis for the positive answer to the question as to why legal philosophy is necessary for jurists when they address controversies connected with the use of force for humanitarian motives. The author rejects the legal philosophy that accepts the dictum "illegal, but legitimated", because he considers it to be logically self-contradictory and something that weakens legal certainty within the legal order. At the same time, he argues for constructing a legal philosophy from from inner perspective, that is, one based on a thorough acquaintance with the dogmatics of international law and one that takes its theory into consideration.
