dc.abstract.enThe article discusses statutory exemption provisions governing the actions of public authorities that were drafted and enacted in Poland during the COVID-19 pandemic. It offers a comprehensive compilation and comparison of these provisions. It analyses the individual regulations, considering comments submitted during the legislative process, as well as interpretations presented in the criminal-law literature. The study demonstrates that the COVID-19 statutory exemptions conflicted with the standards of a democratic state governed by the rule of law. They were characterised by low legislative quality, and suffered from vagueness and arbitrariness in their statutory criteria. Moreover, they created a risk of asymmetric criminal liability – they exempted public officials from responsibility while simultaneously imposing severe sanctions on numerous actions undertaken by citizens in the exercise of their constitutional rights and freedoms. The COVID-19 statutory exemptions that did enter into force require a constitutionally oriented, in-depth, rationalising, and restrictive interpretation, as in a democratic state governed by the rule of law public officials cannot be relieved of criminal liability for deliberate and intentional acts committed without a legal basis and in breach of the constitutional principle of legality.
dc.abstract.plW artykule zostały omówione przepisy kontratypizujące, obejmujące działania organów władzy, projektowane i uchwalone w czasie pandemii COVID-19 w Polsce. Opracowanie zawiera kompleksowe zestawienie i porównanie przepisów. Przeprowadzono analizę poszczególnych regulacji, z uwzględnieniem uwag zgłaszanych w procesie legislacyjnym. Wzięto pod uwagę interpretacje zaprezentowane w literaturze karnistycznej. Opracowanie ukazuje, że kontratypy covidowe godziły w standardy demokratycznego państwa prawnego, cechowały się niską jakością legislacyjną. Obarczone były wadą nieostrości i arbitralności przesłanek. Stwarzały ponadto ryzyko asymetrii odpowiedzialności karnej – uwalniały od odpowiedzialności przedstawicieli władzy publicznej, przy jednoczesnym obwarowaniu surowymi sankcjami wielu działań obywateli korzystających ze swoich konstytucyjnych praw i wolności. Kontratypy covidowe, które weszły w życie, wymagają natomiast prokonstytucyjnej, pogłębionej, racjonalizującej i zawężającej wykładni – w warunkach demokratycznego państwa prawa przedstawiciele władzy publicznej nie mogą być uwalniani od odpowiedzialności karnej za świadome i celowe.
