Legalization of unauthorized construction in the case of conducting construction works without a required building permit

Celem ninijeszej pracy magisterskiej jest kompleksowe przedstawienie procedury legalizacji samowoli budowlanej w przypadku prowadzenia robót budowlanych bez wymaganego prawem pozwolenia na budową na podstawie art. 48 i n. ustawy Prawo budowlane oraz ogólne omówienie pozostałych trybów legalizujących. W pracy poruszono rozbierzności pojawiające się w orzecznictwie oraz literaturze przedmiotu, które dotyczą przepisów ustawowych regulujących tematykę legalizacji samowoli budowlanej. W wielu przypadkach niespójność w stosowaniu regulacji ustawowych jest aż nadto widoczna, pomimo kolejnych zmian dokonywanych w materiale normatywnym. Dlatego też przedmiotem rozważań jest zestawienie stanowisk judykatury i piśmiennictwa oraz zaprezentowanie ewentuanych zmian normatywnych, które mogłyby rozwiać powstałe wątpliwości.Ponadto w pracy podkreślono zależność biegu podstępowania legalizacyjnego od inicjatywy samego wnioskodawcy, począwszy od uruchomienia trybu poprzez jego zakończenie w wybranych momentach, a także niejednolite rozumienie pojęcia samowoli budowlanej prezentowane w dorobku sądów administracyjnych.

The purpose of this thesis is to provide a comprehensive overview of the procedure for legalising building malpractice in the event of carrying out construction work without the required building permit under Article 48 et seq. of the Polish Building Code and a general explanation of other legalisation procedures. The paper discusses the inconsistencies arising in the jurisprudence and literature on the subject, which concern the statutory provisions regulating the legalisation of building willfulness. In many cases the inconsistency in the application of statutory regulations is all too apparent, despite subsequent changes made to the normative material. That is why the aim of the paper is to summary the positions of the judicature and the literature and to present possible normative changes that could dispel the doubts that have arisen.Moreover, the paper emphasises the dependence of the legalisation procedure on the initiative of the applicant himself, from the initiation of the procedure through its termination at selected moments, as well as inconsistent understanding of the notion of building unauthorisedness presented by administrative courts.
