Mortgage law of the Kingdom of Poland from years 1818-1825 against a comparative background

Celem niniejszej pracy jest przedstawienie wybranych zagadnień prawa hipotecznego obowiązującego w Królestwie Polskim na podstawie ustaw z 1818 r. i 1825 r. na tle europejskich regulacji hipotecznych z XIX wieku. W pierwszej kolejności przedstawiony zostaje rys historyczny ewolucji prawa hipotecznego obowiązującego na ziemiach polskich przed 1818 r. Szczególny nacisk zostaje położony na opisanie postanowień konstytucji sejmowej z 1588 r. oraz przedstawienie historii procesu legislacyjnego, zakończonego uchwaleniem ustawy hipotecznej z 1818 r. Główna część pracy poświęcona jest przedstawieniu ustawodawstwa hipotecznego obowiązującego w Królestwie Polski oraz we Francji, Austrii i Niemczech. W części tej analizie zostają poddane zagadnienia związane z budową rejestrów hipotecznych, odpłatnym przeniesieniem własności nieruchomości, charakterystyką instytucji hipoteki oraz ukształtowaniem zasad rządzących prawem hipotecznym. W powyższym zakresie przedstawione zostają przepisy ustawy hipotecznej z 1818 r. i 1825 r., Kodeksu Napoleona, ABGB, austriackiej ustawy o księgach gruntowych z 1871 r., BGB oraz niemieckiej ustawy o księgach gruntowych z 1897 r. Rozdziały poświęcone zagranicznemu ustawodawstwu hipotecznemu zostają dodatkowo zakończone wskazaniem zasadniczych różnic i podobieństw między unormowaniami analizowanych aktów prawnych a prawem hipotecznym Królestwa Polskiego.

The purpose of this paper is to present selected issues of mortgage law binding in the Kingdom of Poland on the basis of the laws of 1818 and 1825 against the background of selected European regulations from the 19th century. Firstly, the historical outline of the evolution of mortgage law in force in Poland before 1818 is presented. Particular emphasis is placed on describing the provisions of the Sejm's constitution from 1588 and presenting the history of the legislative process, culminating in the adoption of the Mortgage Act of 1818. The main part of the paper is dedicated to presenting mortgage legislation in force in the Kingdom of Poland and in France, Austria and Germany. In this part of the analysis, issues related to the construction of mortgage registers, the transfer of ownership of property, the characteristics of the mortgage institution and the formation of the rules governing the mortgage law are discussed. The provisions of the Mortgage Law of 1818 and 1825, the Napoleonic Code, ABGB, the Austrian Land Register Act of 1871, the BGB and the German Land Register Act of 1897 are covered in this section. The chapters on foreign mortgage legislation are additionally completed with an indication of the fundamental differences and similarities between the norms of the analyzed legal acts and the mortgage law of the Kingdom of Poland.
