Legal definitions in the light of Legislative Techniques Principle

W związku ze specyfiką języka prawnego, w aktach prawnych znajdują się definicje legalne wskazujące w jaki sposób rozumieć pojęcia w nich występujące. W pracy omówiono definicje legalne bazując głównie na wytycznych zawartych w Zasadach Techniki Prawodawczej. Na wytycznych z ZTP oparto także kryteria, według których uznano definicje występujące w aktach prawnych za legalne. W ten sposób ustalono granice definicji oraz scharakteryzowano je pod kątem rodzajów definicji takich jak: definicje sprawozdawcze i projektujące, równościowe i nierównościowe, klasyczne i zakresowe, różne stylizacje definicji, a poniekąd także: realne i nominalne oraz intrajęzykowe i metajęzykowe. Na potrzeby pracy przeanalizowano także kilka aktów prawnych pod kątem występujących w nich definicji.

With respect to specific nature of the legal language, in legal acts are legal definitions, which indicating how to understand notions of them occurring. In this work discussed legal definitions base mainly on guidelines, which have contained in principles of legislative technique. The guidelines of ZTP based on parameters, according to which the definitions found in legal acts for legal. In this way established limits definition and described the for types of definitions such as: reporting and design, equality and unequality, classic and rangal, different stylizations definition, and somewhat also: real and nominal definition or intralanguage and metalanguage. This work explores several legal act for occurring in the definition also.
