Deepfake Technology and the Rights of Performing Artists

Niniejsza praca licencjacka koncentruje się na problematyce dynamicznie rozwijającej się technologii deepfake. W pierwszym rozdziale, stanowiącym wprowadzenie merytoryczne, przedstawiono mechanizmy powstawania tej technologii oraz dokonano klasyfikacji jej głównych rodzajów. Kolejna część opracowania poświęcona została analizie statusu prawnego technologii deepfake, zarówno w świetle regulacji unijnych, ze szczególnym uwzględnieniem rozporządzenia AI Act, jak i w kontekście krajowego porządku prawnego. Ostatni rozdział pracy podejmuje zagadnienie relacji pomiędzy technologią deepfake a prawami artystów wykonawców, kładąc nacisk na problematykę prawa do wizerunku oraz prawa do wynagrodzenia wynikającego z eksploatacji artystycznego wykonania.

This bachelor’s thesis focuses on the issues surrounding the rapidly developing deepfake technology. The first chapter, serving as a substantive introduction, outlines the mechanisms behind the creation of this technology and provides a classification of its main types. The subsequent part of the study is devoted to an analysis of the legal status of deepfake, both in the context of European Union regulations—particularly the AI Act—and within the framework of the national legal system. The final chapter addresses the relationship between deepfake technology and the rights of performing artists, with particular emphasis on the right to one’s image and the right to remuneration arising from the exploitation of artistic performances.
