The powers of the Council of Ministers of the Republic of Poland in foreign affairs

Przedmiotem niniejszej pracy jest charakterystyka kompetencji Rady Ministrów, w jednej z najważniejszych, dla funkcjonowania współczesnego państwa dziedzin, jaką jest polityka zagraniczna. W pracy ukazano pozycję Rady Ministrów, jako organu zajmującego pozycję dominującą w zakresie spraw zagranicznych, któremu Konstytucja Rzeczypospolitej Polskiej z 2 kwietnia 1997 r. wprost przyznaje uprawnienie do prowadzenia polityki zagranicznej. Przedstawiono także pozycję Ministra Spraw Zagranicznych w sferze stosunków międzynarodowych oraz dokonano analizy jego najistotniejszych, w tym zakresie funkcji takich jak: reprezentacja Rzeczypospolitej Polskiej na arenie międzynarodowej, utrzymywanie stosunków z innymi państwami i organizacjami międzynarodowymi, a także bezpośrednie zwierzchnictwo nad zagranicznymi przedstawicielstwami oraz kierowanie działalnością misji dyplomatycznych. Ponadto w niniejszym wywodzie dokonano analizy roli Rady Ministrów oraz podejmowanych przez nią działań w strukturach Unii Europejskiej. Podkreślono działania Rady Ministrów w tej specyficznej, nie dającej się jednoznacznie zakwalifikować, ani do tradycyjnie pojmowanej polityki zagranicznej, ani też wewnętrznej, dziedzinie. W ostatnim rozdziale przedstawiono problematykę wzajemnych stosunków Rady Ministrów z innymi organami władzy państwowej, również posiadającymi pewne kompetencje, z zakresu polityki międzynarodowej, Prezydentem Rzeczypospolitej Polskiej a także Sejmem i Senatem. Zwrócono uwagę na poszczególne uprawnienia, które pozostają względem siebie w relacji, a także możliwe oraz wynikłe na tym tle konflikty.

The aim of this essay is the characterization of the competences of the Council of Ministers, in one of the most important areas for the functioning of the contemporary state, which is foreign policy. The work presents the position of the Council of Ministers as the body holding a dominant position in the field of foreign affairs, to which the Constitution of the Republic of Poland of April 2, 1997 directly admits the right to conduct foreign policy. The thesis describes the position of the Minister of Foreign Affairs in the sphere of international relations and the most important functions in this field such as: representation of the Republic of Poland on the international arena, maintaining relations with other states and international organizations, and direct supremacy over foreign representations and management of the mission diplomatic. In addition, this report analyzes the role of the Council of Ministers and the activities it undertakes in the structures of the European Union. The work describes the actions of the Council of Ministers in this specific, unidentifiable, or traditional foreign concept, or internal, in this field. The last chapter presents the issues of mutual relations between the Council of Ministers and other organs of state authority, also possessing certain competences in the field of international politics, the President of the Republic of Poland, as well as the Sejm and the Senate. Attention is paid to the individual rights that remain in relation to each other, possible conflicts and resulting conflicts.
