The independence of judges in the Polish legal system

Niniejsza praca ma na celu ukazanie fundamentalnej roli, jaką w systemie demokratycznego państwa prawa pełni zasada niezawisłości sędziowskiej.Pierwszy rozdział niniejszej pracy obejmuje zagadnienia związane z istotą zasady niezależności sądów, pojęciem i rozumieniem zasady niezawisłości sędziowskiej w polskim systemie prawnym, a także z aspektami niezawisłości sędziowskiej prezentowanymi w wybranych aktach normatywnych prawa międzynarodowego.Kolejne dwa rozdziały pracy zawierają omówienie najważniejszych gwarancji niezawisłości sędziowskiej przewidzianych w polskim systemie prawnym, w tym gwarancji o charakterze ustrojowym oraz gwarancji o charakterze procesowym.Ostatni - czwarty rozdział pracy poświęcony został Krajowej Radzie Sądownictwa - konstytucyjnemu organowi odpowiedzialnemu za "stanie na straży niezależności sądów i niezawisłości sędziów".

The goal of this thesis is to disclose the fundamental role, which is fulfilled by the independence of judges in the system of the democratic state.The first chapter of this thesis encloses the issues related to the essence of the independence of the courts, the concept and the comprehension of the judicial independence in the Polish legal system, as well as with aspects of the independence of judges presented in the chosen normative acts of the international law.The next two chapters include the report of the most important assurance of the judicial independence foreseen in the Polish legal system, including the guarantees of the institutional and procedural nature.The last - fourth chapter of the thesis is dedicated to the National Council of the Judiciary of Poland - the constitutional authority in charge for "upholding the independence of the courts and the independence of the judges".
