The legislative veto as an instrument of president Aleksander Kwaśniewski’s policy

Weto ustawodawcze jest silnym narzędziem Prezydenta Rzeczypospolitej Polskiej, które w polskim ustroju potrafi determinować całokształt sceny politycznej. Pomimo tego w debacie publicystycznej i naukowej nie jest ono zazwyczaj doceniane, co wiąże się z lekceważeniem ustrojowej pozycji głowy państwa.By dowieść istotności tego uprawnienia autor postanowił opisać realia jego stosowania w okresie prezydentury najdłużej urzędującego dotychczas prezydenta, Aleksandra Kwaśniewskiego. Na opis składa się analiza ilościowa zgłoszonych w ciągu prezydentury wet oraz dokładniejsze przedstawienie kontekstu związanego z najważniejszymi z nich. Do przedstawienia tych zagadnień przeanalizowane zostały między innymi artykuły prasowe, uzasadnienia wniosków prezydenta oraz teksty zawetowanych ustaw.Zgromadzone w pracy informacje mogą posłużyć do prowadzenia dalszych badań, między innymi skupionych na prezydenturze Aleksandra Kwaśniewskiego z perspektywy nauk historycznych i politycznych lub poświęconych zmianom ustrojowej i systemowej pozycji Prezydenta RP na przestrzeni lat. Praca może posłużyć również jako podstawa do sporządzenia analizy porównawczej prezydentur Aleksandra Kwaśniewskiego i Andrzeja Dudy.

Legislative veto is a powerful tool of the President of the Republic of Poland, which in the Polish political system can determine the entire political landscape. In spite of this, it is usually underestimated in journalistic and academic debate, which is associated with disregard for the constitutional position of the head of state. In order to prove the significance of this power, the author decided to describe the reality of its application during the presidency of Aleksander Kwaśniewski, the longest-serving president to this day. The description consists of a quantitative analysis of vetoes submitted during his presidency and a more detailed presentation of the context related to the most important of them. In order to present these matters, press articles, justifications of the president's decisions and the texts of the vetoed acts, among others, have been analysed.The information gathered in this work may be used to conduct further research focused on Aleksander Kwaśniewski's presidency from the perspective of historical and political science or devoted to changes in the constitutional and political position of the President of the Republic of Poland over the years. The paper may also serve as a basis for a comparative analysis of the presidencies of Aleksander Kwaśniewski and Andrzej Duda.
