Extraordinary measures in Polish law

Celem niniejszej pracy magisterskiej jest przedstawienie instytucji stanów nadzwyczajnych w polskim ustawodawstwie. Pierwsze dwa rozdziały stanowią wprowadzenie do tematu poprzez zaprezentowanie ogólnych informacji o stanach nadzwyczajnych oraz skrótowe ukazanie, jak ich obecność w polskim porządku prawnym kształtowała się na przestrzeni czasów. Kolejne rozdziały, będące główną częścią pracy, poświęcone są analizie aktualnej regulacji zawartej w Konstytucji Rzeczypospolitej Polskiej z 1997 r. oraz właściwych ustawach. Rozpoczyna się ona od przedstawienia zasad ogólnych wspólnych dla stanu wojennego, stanu wyjątkowego oraz stanu klęski żywiołowej. Następnie każdy z tych stanów jest badany ze względu na: przesłanki wprowadzenia danego stanu nadzwyczajnego, tryb wprowadzenia, kontrolę decyzji o wprowadzeniu, zasięg terytorialny oraz czas trwania, tryb zakończenia, zasady działania organów władzy publicznej, a także ograniczenia praw i wolności człowieka i obywatela. Ponadto opisane zostały kwestie pozostające w związku ze stanem wojennym, czyli rozporządzenie z mocą ustawy, stan wojny, mobilizacja oraz użycie lub pobyt Sił Zbrojnych poza granicami Rzeczypospolitej Polskiej.

The aim of this master’s thesis is to present the institution of extraordinary measures in Polish law. The first two chapters provide an introduction to the topic by presenting general information about extraordinary measures and briefly show how their presence in the Polish legal system has been developing over the years. The following chapters, which are the main part of the thesis, are devoted to the analysis of the current regulation contained in the Constitution of the Republic of Poland of 1997 and the relevant statutes. It begins with the introduction of general principles common to martial law, a state of emergency and a state of natural disaster. Then each of these states is examined on the grounds of: conditions for the introduction of extraordinary measures, the procedure of the introduction, the control over the decision on the introduction, the territorial and duration scope, the procedure of the termination, the principles for activity by organs of public authority, and the limitation of the freedoms and rights of persons and citizens. Furthermore, matters connected with martial law also have been described: regulations having the force of statute, a state of war, mobilization and the deployment or the presence of the Armed Forces beyond the borders of the Republic of Poland.
