The functions of the Constitutional Court

Praca magisterska przedstawia najważniejsze kwestie związane z kompetencjami Trybunału Konstytucyjnego w Rzeczypospolitej Polskiej. Celem zawartych w pracy rozważań jest ukazanie najistotniejszych kompetencji Trybunału Konstytucyjnego oraz ukazanie jak te kompetencje z biegiem czasu się zmieniały. W pracy została także przedstawiona działalność pozaorzecznicza Trybunału Konstytucyjnego. Najważniejszym pojęciem które zostało wyjaśnione w pracy jest sąd konstytucyjny. W pracy została ukazana również geneza Trybunału Konstytucyjnego w Polsce. W pracy umieszczone zostały ponad to rozważania nie tylko na temat najważniejszych funkcji Trybunału Konstytucyjnego ale także orzeczeń które ten sąd wydaje i ich skutków prawnych. Ukazuje również modele sądownictwa konstytucyjnego rozróżniając podział na model amerykański i europejski oraz je charakteryzuje. W pracy wielokrotnie odwołuje się do Konstytucji RP z 2 kwietnia 1997, Ustawy o Trybunale Konstytucyjnym z 1 sierpnia 1997 oraz Orzecznictwa Trybunału Konstytucyjnego.

Master of Art thesis presents The Most Important matters related to the competences of the Constitutional Court in the Polish Republic. The aim of the work contained in the most important considerations is to show the competence of the Constitutional Court, and to show how these skills over time was different. The work was also presented non-judicial activities of the Constitutional Court. The most important concept that is explained in this work is a constitutional court. The work has also shown the genesis of the Constitutional Tribunal in Poland. The paper was placed over the consideration not only about the most important functions of Constitutional Court but also judgments to this court issues and their effects. It also shows models of the judiciary's constitutional division of distinguishing between American and European model, and it is characterized. The study makes several references to the Constitution of 2 April 1997, the Constitutional Tribunal Act of 1 August 1997 and the Jurisprudence of the Constitutional Court.
