The crime of offence against religious feelings in the light of the judicature of Polish courts and the European Court of Human Rights.

Tematem niniejszej pracy magisterskiej jest analiza występku obrazy uczuć religijnych (art. 196 KK) na płaszczyźnie dogmatycznej, tj. omówienie znamion typu oraz praktycznej, tj. zbadanie, jak traktują tę kwestię sądy krajowe oraz europejskie. Niniejsza praca składa się z trzech rozdziałów. Pierwszy poświęcony jest dogłębnej analizie czynu zabronionego określonego w art. 196 KK, tj. określeniu przedmiotu ochrony, omówieniu znamion wraz z zaprezentowaniem rozbieżności interpretacyjnych, przedstawieniu błędów wyłączających odpowiedzialność karną, a także kontrowersji związanych z istnieniem tzw. kontratypu sztuki, a co za tym idzie - z problematyką wolności słowa. Drugi rozdział przedstawia dwie sprawy toczące się przed polskimi sądami oraz policyjne statystyki odnoszące się do liczby skazań za przestępstwa z rozdziału XXIV KK. Ostatni rozdział pracy ukazuje kolejne sprawy dotyczące omawianego czynu zabronionego, które trafiły pod osąd ETPC. Wszystkie zaprezentowane sprawy dotyczą działalności artystycznej i stanowią punkt wyjścia do rozważań na temat możliwości ograniczania swobody twórczości kosztem wolności religii.

The subject of this thesis is the analysis of the crime of offence against religious feelings (article 196 of the Polish Penal Code) on the dogmatic ground, i.e. presentation of the features of this offence, and on the practical ground, i.e. research on how this issue is treated by domestic and European courts. This work consists of three chapters. The first one is dedicated to a deep analysis of the crime specified in article 196 of the Polish Penal Code, which means determining the subject of protection, discussing the features of this offence along with disagreements connected with their interpretation, errors excluding criminal liability and controversy which concerns the lawful excuse of art, and, consequently, the issue of freedom of speech. The subsequent chapter is devoted to two cases which were brought before Polish courts and particular police statistics connected with the number of convictions for crimes characterised in chapter XXIV of the Polish Penal Code. The last chapter of this thesis concerns other cases connected with the discussed offence which were judged by the European Court of Human Rights. All these cases are related to art activity. Hence, they lead to particular reflections on possibilities of restricting the freedom of art at the cost of freedom of religion.
