The dispute about the existence and shape of local governemt at the level of poviat

Niniejsza praca stanowi próbę odpowiedzi na pytanie o celowość przywrócenia samorządu powiatowego w Polsce oraz o jego optymalny kształt. Restytucja powiatów stanowiła kluczowy element reform samorządowych decentralizujących władzę publiczną i zakończyła rozpoczęty w 1990 r. proces odbudowy samorządu terytorialnego w Polsce. Dyskusja dotycząca powiatów nie zakończyła się jednak wraz z rozpoczęciem ich działania w 1999 r., ale trwa nadal, zmieniając tylko swoje nasilenie. Mimo kilkunastu lat funkcjonowania tego szczebla samorządu terytorialnego, wciąż podnoszone są głosy postulujące jego likwidację lub głęboką reformę. Skłoniło to autora pracy do poszukiwania źródeł stałych kontrowersji, które towarzyszą powiatom oraz zaprezentowania racji poszczególnych stron sporu o istnienie i kształt samorządu powiatowego. Autor na początku pracy przybliża pojęcia decentralizacji i samorządu terytorialnego oraz wskazuje na zalety, ale także na potencjalne wady decentralizacji państwa poprzez samorząd terytorialny. Następnie dokonana zostaje charakterystyka samorządu powiatowego, ze szczególnym uwzględnieniem jego zadań, pozycji ustrojowej oraz gwarancji prawnych jego samorządności i samodzielności. W kolejnej części pracy znajduje się opis wielkiej dyskusji na temat powiatów rozpoczętej na początku lat 90. W tej części pracy zaprezentowano argumentację obu stron sporu o celowość istnienia samorządu powiatowego, jego alternatywne koncepcje, a także przedstawiono proces wdrażania reformy powiatowej i konstruowania podziału terytorialnego Polski na powiaty. Ostatnia część pracy skupia się na wskazaniu obecnie występujących dysfunkcji, słabości i problemów samorządu powiatowego oraz poszukiwaniu sposobów ich naprawy. Przedmiotem analiz zawartych w niniejszej pracy stały się akty prawne oraz ich projekty, opracowania naukowe, artykuły publicystyczne, a także dane statystyczne. Zróżnicowany charakter bazy źródłowej pozwolił spojrzeć na omawianą problematykę nie tylko jako na zagadnienie prawne, ale także socjologiczne, politologiczne i ekonomiczne.

The present MA thesis is an attempt to answer the question of purposefulness of reinstatement the local government at the level of a poviat in Poland and its optimal shape. Restitution of poviats was the fundamental element of the package of reforms of the local government decentralization the public power and completed, commenced in 1990, process of reconstruction of local government in Poland. The discussion concerning poviats did not end however simultaneously with beginning of its functioning in 1999, but it still lasts, changing only the intensity. In spite of 14 years of functioning of this level of local government, there are still opinions postulating its liquidation or deep reform. It induced the author to search the sources of constant controversies, that accompany the poviats and to present the arguments of the parties of the dispute about existence and shape of local government at the level of poviat. Author at the very beginning of the MA thesis explains the notions of decentralization and local government and indicates the advantages as well as potential disadvantages of the decentralization of the government power via local government. Subsequently the author describes the local government at the level of poviat, particularly its tasks, position and legal guarantees of its home rule and independence. The next part of the thesis contains the description of the great discussion concerning poviats commenced at the beginning of nineties. In that part presented argumentation of both parties of the discussion about the purposefulness of existence of the local government at the level of poviats , alternative concepts as well as the process of implementation the poviat’s reform and construction of Polish poviat division. The last part of the thesis focus on demonstration present dysfunctions, weaknesses and problems of the local government at the level of poviat and search for possible solutions. The subject of the analysis contained in present MA thesis are the legal acts and bills, academic studies, journalistic articles and statistical data. Diversity of the source database enabled to treat the issue not only as a legal problem, but also sociologically, politically and economically.
