Analysis of the possible application of a claim for the elimination of the effects of an unfair market practice

Celem niniejszej pracy było zbadanie możliwości zastosowania roszczenia o usunięcie skutków nieuczciwej praktyki rynkowej.Pierwszy rozdział pracy obejmuje rys historyczny rozwoju europejskiego prawa ochrony konsumentów oraz opisuje cele i historię Dyrektywy 2005/29. W drugim rozdziale omówione zostały elementy Ustawy o przeciwdziałaniu nieuczciwym praktykom rynkowym, które wpływać mogą na interpretację roszczenia o usunięcie skutków nieuczciwej praktyki rynkowej. W trzecim rozdziale dokonano przeglądu stanowisk doktryny i orzecznictwa na temat roszczenia o usunięcie skutków nieuczciwej praktyki rynkowej. Przedstawiono oraz oceniono różne propozycje zastosowania roszczenia o usunięcie skutków nieuczciwej praktyki rynkowej.

The purpose of this thesis was to examine the possible application of the claim for the elimination of the effects of an unfair market practice.The first chapter of the thesis includes a historical outline of the development of European consumer protection law and describes the objectives and history of Directive 2005/29. The second chapter discusses the elements of the Unfair Market Practices Act that may affect the interpretation of the unfair market practice remedy claim. The third chapter reviews the positions of doctrine and case law on the unfair market practice remedy claim. Various proposals for the application of the claim for elimination of the effects of an unfair market practice are presented and evaluated.
