Separate proceedings in cases for divorce.

Tematem niniejszej pracy jest postępowanie odrębne w sprawach o rozwód. W rozdziale pierwszym przedstawiona została ogólna charakterystyka tego postępowania procesowego odrębnego. Rozdział drugi obejmuje omówienie instytucji rozwodu - a w szczególności jej historii, definicji, rodzajów oraz przesłanek rozwodu uregulowanych w Kodeksie rodzinnym i opiekuńczym. W rozdziale trzecim przedstawiono przepisy Kodeksu postępowania cywilnego regulujące przebieg postępowania w sprawach o rozwód. Analizie poddano m.in: wszczęcie tego postępowania, przebieg rozprawy, postępowanie dowodowe, możliwość zawieszenia lub umorzenia postępowania, możliwość przeprowadzenia postępowania mediacyjnego, zasadę wyłączności postępowania rozwodowego, postępowanie zabezpieczające oraz treść wyroku w sprawie o rozwód. Rozdział czwarty poświęcono omówieniu skutków jakie niesie ze sobą orzeczenie rozwodu.

The subject of this thesis is separate proceedings in cases for divorce. The first chapter presents the general characteristics of this separate trial procedure. The second chapter includes a discussion of the institution of divorce - and in particular its history, definitions, types and grounds for divorce regulated in the Family Code and Child Custody. The third chapter presents the provisions of the Code of Civil Procedure governing the course of proceedings in cases for divorce. The analisys included, inter alia, the initiation of this proceeding, the course of the hearing, evidence proceeding, the possibility of suspending or discontinuing the proceedings, possibility of mediation, the principle of exclusive divorce proceedings, safeguard proceedings and the content of the divorce judgment. The fourth chapter is devoted to discussing the effects of a divorce decree.
