Problems of selected translation issues in Polish copyright law

Praca magisterska stanowi analizę zagadnień prawnoautorskich związanych z tłumaczeniami. W tym celu autorka dokonuje przeglądu stanowisk doktryny oraz własnych refleksji dotyczących miejsca tłumaczeń w polskim systemie prawa autorskiego. W centrum zainteresowań autorki pracy znajduje się margines swobody, jakim związani są tłumacze - obiektem rozważań staje się tłumaczenie jako utwór oraz tłumacz jako twórca wraz z przysługującymi mu prawami do utworu. Autorka przybliża problematykę związaną z przesłankami kwalifikującymi tłumaczenie jako utwór zależny, rozumieniem wierności w tłumaczeniu oraz zagadnieniem nieprzekładalności. W dalszej części przedstawione zostają autorskie prawa osobiste do tłumaczenia oraz specyfika przekładu audiowizualnego.

The master's thesis is an analysis of copyright issues related to translations. To this end, the author reviews the doctrinal positions and her own reflections on the place of translations in the Polish copyright system. At the center of the author's interest in the work is the margin of freedom that translators are bound by - the object of consideration becomes translation as a work and the translator as a creator, together with the rights to the work. The author introduces the issues related to the prerequisites qualifying a translation as a dependent work, the understanding of fidelity in translation and the issue of non-translatability. In the next part, the author's moral rights to translation and the specifics of audiovisual translation are presented.
