The dilemmas of humanitarian intervention based on examples of Russian-Georgian war of (2008) and the Syrian conflict (2011 -) - legal aspects

Dylematy interwencji humanitarnej na przykładach wojny rosyjsko-gruzińskiej z (2008 r.) i konfliktu syryjskiego z (2011 r. – ) – aspekty prawneCelem pracy jest zwrócenie uwagi na naruszenia praw człowieka, a przede wszystkim skoncentrowanie się na jednym z najistotniejszych zagadnień z nim związanym czyli interwencji humanitarnej. Debata wokół humanitarnej interwencji zmierza w kierunku rozszerzającej interpretacji tego zagadnienia i zakłada ochronę praw człowieka zarówno w sytuacjach ekstremalnych, jak i na etapie początkowym w ramach działań prewencyjnych. W ostatnich latach wzrosła liczba publikacji, dopuszczających podjęcie interwencji humanitarnej bez uprzedniej zgody Rady Bezpieczeństwa. Jednak mając na uwadze tendencje do nadużyć, uznaje się, że art. 2 ust. 4 Karty NZ ma charakter absolutny, a dwa dopuszczalne wyjątki to prawo do samoobrony (art. 51) i użycie siły za wyraźną aprobatą Rady Bezpieczeństwa.Oryginalność pracy zapewnią odwołania do konfliktu rosyjsko – gruzińskiego z 2008 roku wraz z analizą w oparciu o raport Independent International Fact-Finding Mission on the Conflict in Georgia (IIFFMCG), szczególnie w oparciu o części 1 i 2 tego raportu. A także ocena nierozwiązanego do tej pory konfliktu syryjskiego z 2011 roku. Autor pracy wykaże nieprawidłowości w funkcjonowaniu reżimu Prezydenta Baszara al-Asada zawarte w międzynarodowych raportach. Konfrontując naruszenia z obowiązującym prawem międzynarodowym, w tym konwencjami, których stroną jest Syria zostanie wykazane jak bardzo niebezpieczny jest impas w procedurach

The dilemmas of humanitarian intervention based on examples of Russian-Georgian war of (2008) and the Syrian conflict (2011 -) - legal aspectsThe aim of this study is to draw attention to human rights violations, especially focusing on one of the most important issues connected with them, humanitarian intervention. The debate on humanitarian intervention is moving towards broad interpretation of this issue and assume the protection of human rights both in extreme situations and at an early stage as part of preventive actions. In recent years, an increasing number of publications, allow to undertake the humanitarian intervention without the prior consent of the Security Council. However bearing in mind the tendencies of abuses it is considered that the Article 2(4) of the UN Charter has an absolute character and there are only two acceptable exceptions: the right to self-defence (Article 51) and the Security Council approval , to authorize the use of force.The originality of work will provide a reference to a Russian - Georgian conflict of 2008, together with an analysis based on a report by Independent International Fact-Finding Mission on the Conflict in Georgia (IIFFMCG), particularly on the basis of parts 1 and 2 of this report. And also the evaluation of so far unresolved conflict in Syria from 2011. The author will present the irregularities of the regime of President Bashar al-Assad presented in international reports. Confronting the violations with the applicable international law, including conventions to which Syria is a party will show how dangerous is the deadlock in international procedures in situations that require intervention.
