Reinstate the time limit for lodging an allegations against the order for payment in the proceedings by writ of payment

Tematem niniejszej pracy jest przebieg postępowania w sprawie przywrócenia terminu do wniesienia sprzeciwu od nakazu zapłaty w postępowaniu upominawczym. W pierwszym rozdziale przedstawiono rys historyczny omawianych instytucji (tj. przywrócenia terminu oraz sprzeciwu od nakazu zapłaty). Rozdział drugi poświęcony jest analizie problematyki terminów w postępowaniu cywilnym, a w szczególności instytucji przywrócenia terminu procesowego. Trzeci rozdział zawiera ogólną charakterystykę postępowania upominawczego, z uwzględnieniem jego wszczęcia, przesłanek wydania nakazu zapłaty oraz sposobów jego zakończenia. Ostatni (czwarty) rozdział pracy obejmuje analizę zagadnienia zastosowania instytucji przywrócenia terminu w odniesieniu do sprzeciwu od nakazu zapłaty wydanego w postępowaniu upominawczym (z uwzględnieniem m.in kwestii przesłanek zastosowania tej instytucji oraz sposobów zakończenia postępowania).

The subject of this thesis is the course of the proceedings to reinstate the time limit for lodging an allegations against the order for payment in the proceedings by writ of payment. The first chapter presents the historical background of the discussed institutions (i.e. reinstatement of the time limit and allegations against the order for payment). The second chapter is devoted to the analysis of the issue of time limits in civil proceedings, in particular the institution of restoring the procedural time limit. The third chapter contains the general characteristics of proceedings by writ of payment, including the initiation of proceedings by writ of payment, the prerequisites for issuing a payment order and the methods of its conclusion. The last (fourth) chapter of the thesis includes an analysis of the issue of applying the institution of restoring the time limit in relation to the allegations against the order for payment issued in the proceedings by writ of payment (including, the issue of the prerequisites for the use of this institution and the ways of ending the proceedings.
