Philosophical-political aspects of the debates between Hans Kelsen and Carl Schmitt on the state, the constitution, and its protection

Celem artykułu jest zaprezentowanie kilku podstawowych zagadnień w debacie pomiędzy dwoma wybitnymi przedstawicielami nauki o państwie i prawie: Hansem Kelsenem (1881-1973) i Carlem Schmittem (1888-1985), w tym szczególnie sporu o pojmowanie konstytucji, ochrony porządku konstytucyjnego czy demokracji. W artykule przedstawiono filozoficznopolityczne aspekty debaty, jak również tło historyczne określające kontekst polityczny istotny dla jej zrozumienia. Omówiono także przebieg sporu o strażnika konstytucji, który rozgorzał w okresie międzywojennym w Niemczech weimarskich, ze szczególnym uwzględnieniem okresu 1928-1932.

Te paper aims to present several basic issues in the debate between two prominent representatives of the twentieth-century theory of the state and law: Hans Kelsen (1881-1973) and Carl Schmitt (1888-1985), including in particular the dispute over the understanding of the constitution, protection of the constitutional order, and democracy. Te article presents the philosophical- -political aspects of the debate, as well as the historical background de ning the political context important for its understanding. Te course of the dispute over the guardian of the constitution, which fared up in the interwar period in Weimar Germany, is also discussed in detail, with particular emphasis on the period 1928-1932.
