Functioning of the Security Department of the Detention Centre in Cracow, located at Montelupich Street

Niniejsza praca dotyczy funkcjonowania Działu Ochrony Aresztu Śledczego w Krakowie przy ulicy Montelupich. Areszt śledczy jest szczególnym rodzajem jednostki penitencjarnej. Przebywają w nim osadzeni tymczasowo aresztowani lub oczekujący na inne miejsce odbywania kary. Dział ochrony jest kluczowym elementem aresztu śledczego. Jego funkcjonowanie regulują akty prawne. Praca składa się z trzech rozdziałów. Pierwszy z nich zawiera m.in prawne podstawy działania Służby Więziennej, zadania i obowiązki funkcjonariuszy. W rozdziale tym na podstawie dostępnej literatury oraz aktów prawnych dokonałam charakterystyki Służby Więziennej. Przedstawiłam zasady wykonywania tymczasowego aresztowania. Dokonałam także porównania pomiędzy karą pozbawienia wolności a tymczasowym aresztowaniem. Rozdział drugi został poświęcony historii Aresztu Śledczego w Krakowie, a także przedstawia strukturę organizacyjną i przeznaczenie omawianego aresztu. W ostatnim, trzecim rozdziale opracowano dokumenty własne aresztu śledczego. Rozdział ten obejmuje charakterystykę funkcjonariuszy pracujących w dziale ochrony. Ponadto zamieszczone są informacje o zabezpieczeniach aresztu oraz rozmowy z byłymi funkcjonariuszami Służby Więziennej.

This thesis concerns the functioning of the Security Department of the Detention Centre in Cracow, located at Montelupich Street. The Detention Centre is a special kind of a penitentiary unit where detainees are kept in custody before conviction; there are also placed sentenced people who are waiting for their transfer to another places. The Security Department is a crucial part of the detention centre which is regulated by the legal acts.The thesis consists of three chapters. The first chapter includes the legal framework of the prison service as well as detention officers' duties and responsibilities. The characteristic of the prison service is made on the basis of available literature and legal acts. What is more, rules of the pre-trial detention are also stated in this chapter. Additionally, differences between penalty of deprivation of liberty and provisional detention are described.The second chapter is devoted to the history of the Detention Centre in Cracow. What is more, it presents the organizational structure and the aim of the arrest.The last chapter, presents the Detention Centre's documentation and the characteristic of the detention officers who are working in the Security Department. Furthermore, the chapter contains information about security measures and interviews with former detention officers.
