Judicial and organizationally related to the court proceedings executive authorities

Do wykonywania orzeczeń karnych w postępowaniu wykonawczym powołano szereg organów, które wyposażono w odpowiednie kompetencje służące właściwemu i skutecznemu wykonywaniu orzeczeń. Celem niniejszej pracy jest omówienie organów wykonujących orzeczenia, ich struktury, kompetencji oraz wzajemnych relacji, w ujęciu doktrynalnym, normatywnym i praktycznym, poprzez analizę przepisów prawnych oraz poglądów wyrażonych w literaturze, jak również ukazanie ich funkcjonowania w praktyce. Temat ten opracowano w oparciu o podstawy aksjologiczne. W rozdziale pierwszym omówione zostały zagadnienia terminologiczne, zdefiniowano pojęcie „organ postępowania wykonawczego”, jak również omówiono organy wykonujące orzeczenia na tle historycznym.W rozdziale drugim zaprezentowane zostały kompetencje sądowych organów postępowania wykonawczego- sądu pierwszej instancji lub innego sądu równorzędnego, sądu penitencjarnego, sądu powszechnego, sędziego penitencjarnego oraz prezesa sądu lub upoważnionego sędziego. Rozdział trzeci zawiera rozważania dotyczące organów organizacyjnie związanych z sądem. Omówione zostały uprawnienia i obowiązki sądowego kuratora zawodowego, sądowego kuratora społecznego, kierownika zespołu kuratorskiej służby sądowej oraz komornika sądowego.W rozdziale czwartym przedstawiono kompetencje wojskowych organów postępowania wykonawczego, czyli sądu wojskowego pierwszej instancji lub innego sądu równorzędnego, wojskowego sądu garnizonowego jako sądu penitencjarnego, wojskowych sądów odwoławczych, prezesa sądu wojskowego lub upoważnionego sędziego, wojskowego sędziego penitencjarnego oraz wojskowego kuratora społecznego. Rozdział piąty to analiza wybranych organów postępowania wykonawczego pod względem funkcjonowania w praktyce oraz wnioski dotyczące wprowadzenia zmian oraz usprawnienia działania tych organów.

The execution of judgments in criminal enforcement proceedings set up a number of organs which are equipped with the requisite powers for competent and effective enforcement of judgments. The purpose of this paper is to discuss organs executing court, their structure, competence and mutual relations, in terms of doctrinal, normative and practical, by analyzing legislation and views expressed in the literature, as well as showing their work in practice. This theme was developed based on axiological grounds.The first chapter discusses the issues of terminology, defined the concept of "organ of executive proceedings" as well as discussed the executing authorities ruling on the historical background.In the second chapter presented the competence of judicial authorities for executive organs - first instance court or another court equivalent, the penitentiary court, common court, the penitentiary judge and the president of the court or an authorized judge.The third chapter contains a discussion of the organizational organs related to the court. They discuss the rights and obligations of legal professional trustee, a court probation officer of social, team leader curatorial departments of justice and the judicial officer.The fourth chapter presents the military authorities for execution- the military court of first instance or another court equivalent, the Military Garrison Court as the court of the penitentiary, military courts of appeal, the president of the military court or an authorized judge, military judge and military penitentiary social probation.The fifth chapter is an analysis of selected organs enforcement proceedings in respect of the operation in practice and proposals for changes and improvements of operation.
