On the significance of Ryszard Sarkowicz's conception of levels of interpretation of a legal text

Artykuł ma na celu przedstawienie recepcji koncepcji poziomowej interpretacji tekstu prawnego w teorii prawa oraz jej pewnych walorów teoretycznych. Wybór tego celu wynika z niskiego zainteresowania tą teorią w prawoznawstwie, o czym wspomniano we wprowadzeniu. Następnie nakreślono ewolucję jej kształtu i poruszono kilka jej problematycznych zagadnień zauważonych w literaturze. Pokazano także oddziaływanie koncepcji poziomowej na polską teorię prawa oraz możliwe czynniki wpływające na jej niską popularność.

The article's aim is to present reception of the theory of stratified interpretation of a legal text within legal theory, along with its theoretical merits. The choice of this aim stems from the low level of interest in this conception within legal theory, as mentioned in the introduction. Subsequently, the evolution of the theory is outlined, and several of its issues that have been noted in the literature are mentioned. The influence of the stratified legal interpretation on Polish legal theory is discussed, as well as possible factors contributing to its limited popularity.
