Utility Models as Tools for Protecting Intellectual Property Rights: A Comparative Analysis of the German Jurisdiction and the Philippines

The present paper explores the lesser-known intellectual property regime, the Utility model. The paper conducts a deductive approach in analyzing the features of such an intellectual property regime – taken from an international legal framework, down to zeroing in on two jurisdictions, namely, Germany and the Philippines. The paper provides a parallel study of the relevant legislation, thereby making a comparative analysis of the respective Utility model regimes in the countries under consideration. The examination includes identifying protectable subject matters and other instances relative to obtaining adequate legal protection for Utility models in Germany and the Philippines, including remedies available to right holders in case of infringement of the rights. A better quantitative analysis of the present situation in Germany and the Philippines provides an objective judgment on the status of such an intellectual property regime in both countries’ intellectual property landscapes.
