Tematem niniejszej pracy jest „Postępowanie w sprawach o zatwierdzenie projektu budowlanego i udzielenie pozwolenia na budowę”. W pracy została przestawiona w szczególności instytucja pozwolenia na budowę, jego przesłanki (pozytywne- których spełnienie jest konieczne do uzyskania pozytywnej decyzji o pozwoleniu na budowę oraz negatywne- które dotyczą obligatoryjnej odmowy udzielenia tego pozwolenia), a także analiza postępowania w sprawach o zatwierdzenie projektu budowlanego i udzielenie pozwolenia na budowę. Celem pracy jest przybliżenie procedury pozwoleniowej oraz przedstawienie i omówienie problematyki związanej z wydaniem decyzji o zatwierdzeniu projektu budowlanego i udzielenia pozwolenia na budowę. Pozwolenie budowlane jest decyzją administracyjną, zezwalającą na rozpoczęcie i przeprowadzenie budowy bądź realizowanie robót budowlanych innych niż budowa obiektu budowlanego. Wraz z pozwoleniem budowlanym zasadniczo zatwierdzany jest projekt budowlany, który stanowi integralną część decyzji o pozwoleniu na budowę. Praca wykazała istotność problematyki związanej z postępowaniem w sprawach o zatwierdzenie projektu budowlanego i udzielenie pozwolenia na budowę oraz z uzyskaniem pozytywnej decyzji o pozwoleniu budowlanym.

The subject of this thesis is "Proceedings in matters concerning approval of a construction project and granting a building permit". The thesis presents in particular the institution of the building permit, its premises (positive- whose fulfillment is necessary to obtain a positive decision on the building permit and negative- which relate to the obligatory refusal to grant this permit), as well as an analysis of the proceedings in matters concerning the approval of a construction project and granting the building permit. The purpose of the thesis is to approximate the permit procedure and to present and discuss issues related to the issue of a decision approving a construction project and granting a building permit. The building permit is an administrative decision authorizing the commencement and carrying out of construction or the implementation of construction works other than the construction of a building facility. Along with the building permit, a construction project is generally approved, which forms an integral part of the building permit. This thesis showed the relevance of the issue related to the proceedings in cases for approval of a construction project and granting a building permit and obtaining a positive decision on a building permit.
