The constitutional position and powers of the President of the Republic of Poland

Celem pracy jest przedstawienie i analiza pozycji ustrojowej Prezydenta RP i jego kompetencji. Rozdział pierwszy przedstawia ewolucję instytucji Prezydenta w polskim systemie ustrojowym, poczynając od uchwalenia konstytucji marcowej w 1921 roku do upadku Drugiej Rzeczypospolitej. Następnie przywrócenie urzędu Prezydenta po II wojnie światowej, aż do zniesienia urzędu na podstawie Konstytucji PRL. Opisuję również kształtowanie instytucji Prezydenta w procesie transformacji ustrojowej oraz jego urząd w obecnie obowiązującej konstytucji uchwalonej 2 kwietnia 1997 roku. W rozdziale tym przedstawiam również zasady i tryb wyborów Prezydenta RP, jego odpowiedzialność prawną i zastępstwo Prezydenta RP. W drugim rozdziale opisuję rolę Prezydenta RP w systemie ustrojowym RP, jego organy doradcze oraz przedstawiam akty urzędowe Prezydenta RP, dokonując podziału na akty prawne, które wymagają kontrasygnaty i akty, które stanowią prerogatywy Prezydenta. Rozdział ostatni zawiera kompetencje Prezydenta RP. Opisuję w nim uprawnienia Prezydenta RP wobec władzy ustawodawczej, wykonawczej i sądowniczej oraz w dziedzinie bezpieczeństwa państwa na czas wojny, pokoju, uprawnień w stanach nadzwyczajnych i w dziedzinie spraw zagranicznych, jak również pozostałe kompetencje zawarte w ustawach.

The purpose of the thesis is to present and analyze the constitutional position and powers of the President of the Republic of Poland. In the first chapter the evolution of the institution of the President in the Polish political system is presented, beginning from the enactment of the March Constitution in 1921 to the fall of the Second Polish Republic. Then the restoration of the Office of the President after the Second World War, until the abolition of the Office pursuant to the Constitution of the People's Republic of Poland. It also describes the evolution of the institution of the President in the process of transition and its Office in the current Constitution adopted on 2 April 1997. This chapter also deals with principles of the election of the President, his legal liability and substitution of the President of Poland. The second chapter describes the role of the President in the Polish political system, his advisory bodies and official acts, distinguishing between legislative acts which require countersigning and acts, which are the prerogative of the President. The final chapter contains the powers of the President of Poland. It describes the powers of the President to the legislative, executive and judicial power and in the field of national security in time of war, peace, his rights in emergency situations and in the area of foreign affairs, as well as other powers contained in the acts.
