Legal status of animals and the postulate of their legal empowerment on the background of the conception of rights of nature

Praca stanowi analizę obecnego statusu prawnego zwierząt oraz postulatów jego zmian w kierunku ich upodmiotowienia w kontekście teorii koncepcji praw natury oraz przykładów wprowadzenia jej do zagranicznych porządków prawnych. Pracę podzielono na cztery części. W pierwszej z nich zostały zarysowane zagadnienia prawnej podmiotowości, własności, pojęcia zwierzęcia oraz źródeł prawnej ochrony zwierząt w Polsce, w ramach której omówiono pojęcia ochrony gatunkowej, humanitarnej i weterynaryjnej oraz relację między ochroną zwierząt a Konstytucją Rzeczypospolitej Polskiej. Przedmiotem drugiej części są obowiązujące regulacje dotyczące statusu prawnego zwierząt ze szczególnym uwzględnieniem problematyki dereifikacji i różnych stopni ochrony przysługującym różnym kategoriom zwierząt, a także problemów ochrony humanitarnej w związku z regulacjami prawa cywilnego i karnego. Część trzecia zawiera omówienie kontekstu powstania oraz teoretycznych założeń koncepcji praw natury. Ponadto dokonano analizy regulacji wprowadzających tę koncepcję w życie w wybranych państwach. Czwarta część poświęcona jest postulatowi prawnego upodmiotowienia zwierząt, postulatom de lege ferenda oraz problemom z nim związanym. Przeprowadzona analiza pozwoliła na zlokalizowanie problemów występujących w obecnie obowiązujących regulacjach humanitarnej ochrony zwierząt oraz na odpowiedź na pytanie, czy problemy te mogą zostać zażegnane poprzez wprowadzenie do polskiego porządku prawnego prawnej podmiotowości zwierząt.

The thesis is an analysis of the current legal status of animals and the postulates of its changes in the direction to their legal empowerment in the context of the conception of the rights of nature and the examples of bringing this conception into force in foreign legal orders. The thesis is divided into four sections. In the first one the issues of legal personhood, ownership, the term of an animal and the sources of animal protection law in Poland, which consists of the matters of species, humanitarian and veterinary protection as well as the relation between animal protection and the Polish Constitution, were featured. The subject matter of the second part is the current legal status of the animals, especially the issues of dereification and different extents of protection given to different categories of animals and the friction between animal protection law and civil and penal law. The third section includes the genesis and theoretical premises of the conception of rights of nature. Moreover, the implementation of this conception in selected countries was analyzed. The fourth section is focused on the postulate of animals' legal empowerment, postulates de lege ferenda and problems of the first postulate. The execution of the analysis has led to delineation of problems of effective animal humanitarian protection law and the conclusion, whether or not these problems may be solved through the implementation of the legal personhood of animals into the polish legal order.
