The final moment of the limitation period for claims caused by a tort

The article focuses on the issue of the applicability of Art. 118 second sentence of the Civil Code to claims for damages resulting from a tort, the limitation of which is mainly regulated by Art. 4421 of the Civil Code. The author is of the opinion that the rule set out in Art. 118 second sentence of the Civil Code is applicable to such claims; therefore, they generally expire at the end of the calendar year in which the period specified in these provisions elapsed, and not at the end of this period. In addition, the article deals with the issue of determining the final moment of the limitation period in situations where the so-called deferment of the expiry of the limitation period occurs - in the context of tort claims - in the cases referred to in Art. 4421 § 3 and 4 of the Civil Code. The author recognizes that the deferment of the expiry of the limitation period for tort claims takes place until the time resulting from the provisions providing for such suspension, and not until the end of the calendar year in which the period specified therein expired.
