Death penalty as a preventive measure intended to protect society

W niniejszej pracy przedstawiono zjawisko funkcjonowania kary śmierci jako środka prewencyjnego służącego ochronie społeczeństwa. Dokonano analizy stosowania tej kary w Stanach Zjednoczonych oraz w historii Rzeczypospolitej Polskiej, a następnie porównano te kraje. Omówiono skalę przestępczości występującą w obu państwach oraz przedstawiono, jaki wpływ może mieć obecność kary śmierci w kodeksie karnym na zmniejszenie ilości przestępstw. Ocenie poddany został również stosunek części społeczeństwa polskiego do kary śmierci, czego dowiedziono na podstawie anonimowej ankiety przeprowadzonej za pomocą Formularza Google. W rezultacie przeprowadzonych badań wykazano, że kara śmierci nie spełnia jednak funkcji odstraszającej i nie wpływa na zmniejszenie skali przestępczości w Stanach Zjednoczonych. Analiza ankiet pozwala dodatkowo na stwierdzenie, że badana grupa nie chce przywrócenia kary śmierci w Polsce, gdzie i bez tej sankcji co roku obserwowany jest spadek ilości morderstw.

The following paper analyzes the functioning of the death penalty as a preventive measure of social protection. A comparative analysis of the use of capital punishment in the United States and in the history of the Republic of Poland was conducted in order to juxtapose both countries. The scale of crime occurring in both countries was also discussed along with a possible influence that the presence of death penalty has on the reduction of crime. A part of Polish society was subjected to an assessment of their views on the death penalty, as evidenced on the basis of an anonymous survey conducted by Google Form.The results of the conducted study show that the death penalty does not function as a deterrent and does not affect the crime rates in the United States in any way. Analysis of the survey additionally allows to establish that the test group does not wish the death penatly to be restored in Poland, where a decrease in the number of murders is observed every year even without the capital punishment.
