The constitutional position of the special services in selected countries of the common law system

Służby specjalne działają w realiach tajemnicy. Ich wewnętrzne zasady funkcjonowania pozostają po za możliwością weryfikacji ze strony szarego człowieka. Jest jednak pewna sfera służb się tycząca, którą poznać może każdy. Mowa tutaj o sferze prawnej kształtującej ich ustrojową pozycją, jako jednej z państwowych instytucji. I tak jak różne są służby, tak różna jest ich pozycja prawna. Zależne jest to od wielu czynników, wśród których wyróżnia się system polityczny i prawny danego państwa. Celem niniejszej pracy jest próba zrozumienia i opisu prawnych uwarunkowań działania służb w systemie prawa anglosaskiego, jakże odmiennego od systemu prawa w wydaniu kontynentalnym. Przykłady opisane w pracy dotyczyć będą służb Wielkiej Brytanii, Nowej Zelandii i Kanady. Kwestie te uzupełnione zostały przez wskazanie genezy źródeł prawa w systemie anglosaskim oraz opis systemów politycznych państw pozostających w sferze zainteresowania niniejszej pracy. Wielka Brytania stanowi tutaj punkt wyjścia, będąc pierwotnym źródłem prawa anglosaskiego.

The special services operate in a reality of secrecy. Their internal rules of operation remain beyond the ability of the ordinary person to verify. However, there is a certain sphere of the services that everyone can get to know. We are talking about the legal sphere shaping their systemic position as one of the state institutions. And just as the services are different, so is their legal position. This depends on many factors, among which stand out the political and legal system of the country. The purpose of this work is to try to understand and describe the legal conditions of the services in the Anglo-Saxon legal system, which is very different from the continental legal system. The examples described in the work will concern the services of Great Britain, New Zealand and Canada. These issues are supplemented by an indication of the genesis of the sources of law in the Anglo-Saxon system and a description of the political systems of the countries of interest in this work. Great Britain is the starting point here, being the original source of Anglo-Saxon law.
