Nationwide referendum as a basic form of implementation of direct democracy in Poland.

Celem niniejszej pracy jest scharakteryzowanie referendum ogólnokrajowego jako zasadniczej formy realizacji demokracji na tle polskiej rzeczywistości. W pierwszym rozdziale dokonano dyskursywnej analizy ważniejszych pojęć z obszaru problematyki ogólnej i teoretycznej dotyczącej demokracji. Dokonano również opisu formy realizacji zasady zwierzchniej władzy. Drugi rozdział opisuje w szerokim kontekście, instytucję referendum w nauce i praktyce polskiego prawa konstytucyjnego. Obok omawianych pojęć, charakterystyce poddane zostały konstytucyjne zasady i tryby przeprowadzania referendum. Scharakteryzowano w nim również organy do spraw referendum oraz kampanię referendalną i sposób jej przeprowadzania. Trzeci rozdział został poświęcony sposobom określania wyników i ważności referendum. Przeanalizowano również zalety i wady referendum. Czwarty rozdział opisuje praktykę referendum w świetle obowiązującego ustawodawstwa. Przedstawiono w nim geneza instytucji referendum ogólnokrajowego oraz zakres konstytucyjnej i ustawodawczej regulacji referendum. Poruszono w nim również zagadnienie referendum akcesyjnego, jak i przedstawiono miejsce i rolę referendum ogólnokrajowego w przedstawicielskim systemie rządów. Pracę podsumowuje zakończenie oraz wykaz literatury i spisy tabel i rysunków. W pracy wykorzystano głównie publikacje takich autorów jak: M. Musiał – Karg, E. Wnuk – Lipiński, J. Bocheński, W. Skrzydło oraz M. Jabłoński.

This thesis aims at characterizing the nationwide referendum as a basic form of implementation democracy against a background polish reality. In the first chapter is done the analysis of crucial terms from areas of general and theoretical topic pertain to democracy. It’s been defined description of a form of implementation rule of Joint Chiefs of Staff.The second chapter describes in a wide context the institution of a referendum in science and practice of polish constitutional law. Next to covered ideas, the constitutional rules and procedure of carry out referendum were characterized. Also the legislative body related to referendum matters and referendum campaign, the way it’s carried out, all that matters are described in this part. The third section is devoted to the ways of estimation and validity of referendum. It was thought through about advantages and disadvantages of referendum. The fourth chapter describes the practical referendum in the view of obligatory legislation. It presented the origins of institution of nationwide referendum and the area of constitutional and legislative control of referendum. Mentioned also about referendum accession likewise it was introduced the place and the role of nationwide referendum in representative system of government. In this thesis there were several publications used, mainly such authors as: M. Musiał – Karg, E. Wnuk – Lipiński, J. Bocheński, W. Skrzydło and M. Jabłoński.
