The organization of theme and rheme in the Basic Law of the Federal Republic of Germany – a textlinguistic study

Celem niniejszej pracy było zbadanie regularności w organizacji tematu i rematu w tekstach prawnych, jak również zbadanie, czy powyższy schemat odbiega od typowej organizacji tematu i rematu na poziomie komunikacyjnym. W tym celu postawiono następujące pytanie badawcze: jak zorganizowane jest aktualne rozczłonkowanie zdania w Ustawie Zasadniczej Republiki Federalnej Niemiec i jakie konsekwencje ma to dla tekstu? Aby odpowiedzieć na pytanie badawcze wprowadzone zostały, w oparciu o literaturę fachową, podstawy teoretyczne stojące za aktualnym rozczłonkowaniem zdania oraz juryslingwistyką, które posłużyły jako podstawa do przeprowadzenia językoznawczej analizy tekstów prawnych. Językoznawcza analiza tekstu wykazała, iż badany tekst prawny charakteryzuje się regularną organizacją tematu i rematu. Regularność ta jest szczególnie widoczna w zakresie działalności tematu. Ponadto analiza wykazała, iż Ustawa Zasadnicza RFN w znaczącym stopniu odbiega od typowego, linearnego sposobu organizacji tekstu. Powyższe oznacza, iż, ze względu na swoją regularność, temat ma duży wpływ na progresję tematyczną w tekście. Na tej podstawie zaleca się przeprowadzenie precyzyjnego badania progresji tematycznej w tekstach prawnych, która jako materiał badawczy mogłaby przyczynić się do uproszczenia języka prawnego.

The aim of this thesis is to explore how regular the network of theme and rheme (topic and comment) in legal texts is and whether it aberrates from a typical theme and rheme organization on the communicational level. Therefore, the following research question is put: ‘in what way is the theme and rheme organization formed in the Basic Law of the Federal Republic of Germany and what consequences does it cause?’ In order to answer the research question, the theoretic basics behind the notion of theme and rheme and the linguistics of law have been thoroughly presented and discussed, subsequently serving as a base for the textlinguistic study of legal texts. The textlinguistic analysis has shown that the legal text is characterized by a regular organization of theme and rheme. This regularity is particularly to be seen in the notion of the theme. Moreover, the analysis has shown that the Basic Law of the Federal Republic of Germany significantly deviates from a typical, linear way of text organization. The above means that the theme, because of its regularity, has a heavy impact on the thematic progression of the text. Based on that, it should be advised to conduct a precise research of the thematic progression in legal texts that could be of use as material for simplification of the legal language.

Das Ziel der vorliegenden Arbeit ist es herauszufinden, wie regelmäßig Thema und Rhema in Gesetzestexten gestaltet wird und ob es kommunikativ von der typischen Thema-Rhema-Gliederung abweicht. Dazu wird folgende Forschungsfrage gestellt: Wie ist die Thema-Rhema-Gliederung in dem Grundgesetz für die Bundesrepublik Deutschland gestaltet und welche Konsequenzen können daraus gezogen werden?Um die Forschungsfrage zu beantworten wurden anhand der Fachliteratur die theoretischen Grundlagen hinter der Thema-Rhema-Gliederung und Jurislinguistik dargestellt, die als Vorgaben für die textlinguistische Analyse der Gesetzestexte verwendet worden sind. Die textlinguistische Analyse hat gezeigt, dass der Gesetzestext stark durch eine regelmäßige Aneinanderreihung von dem Thema und dem Rhema geprägt ist. Die Regelmäßigkeit ist besonders sichtbar in der Wirkungsdomäne des Themas. Die Analyse hat darüber hinaus gezeigt, dass das Grundgesetz für die Bundesrepublik Deutschland wesentlich von der typischen linearen Textgestaltung abweicht.Dies zeigt, dass das Thema, wegen seiner Regelmäßigkeit, die thematische Progression innerhalb des Textes stark beeinflusst. Auf dieser Grundlage ist es empfehlenswert, eine präzise Untersuchung der thematischen Progression in Gesetzestexten durchzuführen, was als Material für die Vereinfachung der Gesetzessprache dienen könnte.
