Contractual lien on claim

W pracy przedstawiona została konstrukcja zastawu na wierzytelności. Problematyka zastawu została opracowana w dziesięciu rozdziałach. Prawem obciążonym zastawem jest wierzytelność. Analizowane jest zagadnienie odpowiedniego stosowania przepisów o zastawie na rzeczach do zastawu na wierzytelności. Przedstawiono treść zastawu na wierzytelności jak również zagadnienie zmiany treści zastawu. Wskazano wierzytelności, które mogą być zabezpieczone zastawem oraz wierzytelności, które mogą być obciążone zastawem. W kolejnych rozdziałach zaprezentowano zagadnienia ustanowienia zastawu, przeniesienia wierzytelności zabezpieczonej zastawem, pierwszeństwa zastawu, ochrony zastawu, zaspokojenia zastawnika oraz wygaśnięcia zastawu.

The purpose of this thesis is the analysis of the construction of lien on claim. The issues of lien are presented within ten chapters. The right pledged is the claim. There appears the issue of applying regulations of pledge of movables accordingly to lien on claim. In this paper is presented the construction of lien on claim, as well as the change of the construction of lien. Furthermore there are indicated matter of liability secured by pledge and the burden claim. In subsequent chapters are analysed issues of the pledge a right, the transfer of proof of debt, the priority of lien, protection of the lien, the satisfaction of secured creditor and the expiration of lien.
