Substantive Due Process – Contemporary United States Supreme Court Jurisprudence with Respect to the Right to Privacy

Praca skupia się na współczesnym kierunku orzecznictwa Sądu Najwyższego Stanów Zjednoczonych w stosunku do doktryny substantive due process w kontekście prawa do prywatności i powiązanych z nim praw reprodukcyjnych oraz kwestii autonomii cielesnej. Głównym celem pracy jest zbadanie, w jaki sposób decyzja Sądu Najwyższego w sprawie Dobbs v. Jackson Women's Health Organization, poprzez odejście od precedensowej linii orzecznictwa, otworzyła drogę do zakwestionowania innych praw fundamentalnych. Rozdział pierwszy omawia koncepcję due process of law w Stanach Zjednoczonych, rolę Sądu Najwyższego oraz doktrynę judicial review. Drugi koncentruje się na prawie do prywatności, jego historii i podstawach prawnych oraz kwestii ochrony praw fundamentalnych. Rozdział trzeci zawiera analizę wybranego orzecznictwa Sądu Najwyższego. Ostatni rozdział przedstawia wnioski i prognozy dotyczące przyszłości interpretacji substantive due process w odniesieniu do innych praw fundamentalnych.

The work focuses on the contemporary direction of the U.S. Supreme Court's jurisprudence concerning the doctrine of substantive due process, in the context of the right to privacy, associated reproductive rights and issues of bodily autonomy. The primary objective of the work is to examine how the Supreme Court's decision in Dobbs v. Jackson Women's Health Organization, by departing from established precedents, has paved the way for challenging other fundamental rights. The first chapter discusses the concept of due process of law in the United States, the role of the Supreme Court, and the doctrine of judicial review. The second chapter concentrates on the right to privacy, its history and legal foundations, and the issue of fundamental rights protection. The third chapter contains an analysis of selected Supreme Court decisions. The final chapter presents conclusions and forecasts regarding the future interpretation of substantive due process in relation to other fundamental rights.
