Phenomenological analysis of law reality.

Praca zajmuje się zagadnieniem fenomenologii i jej ewentualną przydatnością w życiu prawnika. Autor starał się w niniejszej pracy prześledzić rozój myśli i nurtu fenomenologicznego na przestrzeni wieków. O tym przede wszystkim traktuje pierwszy rozdział pracy. W następnych rozdziałach czytelnik odnajdzie pogłębioną analizę filozoficzną zarówno ogólnych zagadnień fenomenologii, jak i jej szczególnego przypadku, tj. fenomenologii prawa. Rozważania w głównej mierze nawiązują do prac A. Reinacha i T. Bekrychta. Autor dokonał całościowej analizy podstawowych założeń i praw fenomenologii, oraz naniósł jej siatkę pojęciową oraz metodologię, na sferę prawa. Ponadto autor dokonał rozważań na temat wzajemnych relacji między tym nurtem filozoficznym a prawem pozytwynym, uwzględniając wszelkie wpływy moralności na porządek prawny. Wreszcie w ostatnim z rozdziałów, autor starał się ukazać aspekt fenomenologicznego ujęcia sfery prawnej poprzez pryzmat jej możliwych, praktycznych zastosowań. Kończąć swój wywód, w krótkim podsumowaniu autor ukazuje możliwe drogi rozwoju dla tego kierunku i dokonuje jego oceny.

Work deals with the problem of the phenomenology and its possible usefulness in the life of a lawyer. In this paper the author tried to follow the development of phenomenological thought and trend over the centuries. This is the main point of interest of the first chapter. In the following chapters, the reader will find an in-depth analysis of both the general philosophical issues of phenomenology and its special case, ie. the phenomenology of law. Considerations mainly refer to the work of A. Reinach and T. Bekrycht. Author made ​​a comprehensive analysis of the basic principles and rights of phenomenology, and charted the conceptual grid and methodology on the realm of the law. In addition, the author has made discussion on the mutual relationship between the phenomenology and legal Positivism , including any moral influence on law order.Finally, in the last chapter, the author tried to show the phenomenological aspect of the legal sphere through the prism of its possible practical applications. At the end of the work, the author presents a brief summary of possible future development of phenomenology and made an evaluation of this trend.
