Artykuł porusza problem dezinformacji w obszarze wiedzy medycznej i zwalczania medycznych fake-newsów za pomocą prawa karnego. W artykule zwrócono uwagę na problemy kryminalizacji medycznych fakenewsów. Zostały omówione propozycje legislacyjne obejmujące kryminalizację rozpowszechniania informacji sprzecznych z aktualną wiedzą medyczną. Omówiono znamiona zaproponowanych przepisów oraz zagrożenia związane z ich wykładnią w praktyce sądowej, w tym znamię „rozpowszechnia”, wymóg oczywistej sprzeczności fake-newsa z wiedzą medyczną, społeczną szkodliwość czynu oraz stosunek mentalny sprawcy do czynu. Wskazano, iż prawo karne może pomóc w zwalczaniu najbardziej karygodnych działań obejmujących szerzenie dezinformacji w obszarze medycyny.

The article discusses the problem of disinformation in the field of medical knowledge and the possibility of combating medical fake news by means of criminal law. The article highlights the problems of criminalizing medical fake news. Two legislative proposals involving the criminalization of dissemination of information contrary to current medical knowledge are discussed. The discussion concerns elements of offences in the proposed regulations and the dangers connected with interpreting them in court practice, including the element of ‘dissemination’, the requirement of fake news evidently contradicting medical knowledge, the social harmfulness of the act, and the mental attitude of the perpetrator to the act. It is pointed out that criminal law can help combat the most reprehensible actions involving the spread of disinformation in the medical field.
