Competences of the Minister of Justice and the Minister of Defence in relation to military courts

Przedmiotem niniejszej pracy licencjackiej pt. Kompetencje Ministra Sprawiedliwości i Ministra Obrony Narodowej wobec sądów wojskowych, jest przedstawienie kompetencji, w jakie zostały wyposażone dwa organy administracji - Minister Sprawiedliwości i Minister Obrony Narodowej, w stosunku do sądów wojskowych. Celem pracy jest pokazanie również zestawienia władzy sądowniczej z władzą wykonawczą na przykładzie zasady podziału i równowagi władz. W poszczególnych rozdziałach pracy przedstawiono sądy wojskowe jako organy władzy sądowniczej oraz ich rys historyczny, strukturę i zakres orzecznictwa. Praca licencjacka przedstawia również organy administracji jako organy władzy wykonawczej wraz z ich kompetencjami wobec sądownictwa wojskowego, w zakresie indywidualnym oraz w odniesieniu do wzajemnych relacji obu ministrów. Omawiane kompetencje koncentrują się głównie na możliwościach nadzorczych i kontrolnych omawianych podmiotów władzy wykonawczej.

The object of this Bachelor's thesis, entitled Competences of the Minister of Justice and the Minister of Defence about military courts, is to present the competencies with which the two administrative bodies, the Minister of Justice and the Minister of Defence, have been endowed about military courts. The aim of the work is also to show the juxtaposition of the judiciary and the executive power on the example of the principle of division and balance of powers. The chapters of the thesis present military courts as organs of judicial power and their historical background, structure and scope of jurisprudence. The Bachelor's thesis also presents the administrative bodies as organs of the executive power together with their competencies vis-à-vis the military judiciary, in the individual scope and concerning the mutual relationship between the two ministries. The competencies discussed mainly focus on the supervisory and control capacities of the executive authorities in question.
