Although U.S. courts are mainly able to effectively interpret the Constitution, historically there have been many examples of interpretative activism undertaken by presidents. Even if the chief executives’ impact on the interpretation of the Constitution seems natural, the means by which presidents have tried to determine the meaning of the Constitution have been diverse and sometimes disputable. From the confrontation with other branches of government, through political pressures on legal advisors and the use of different channels of communication, to activities legitimized by controversial theories, chief executives have at times been leading actors in the process of the constitutionalization of politics. The chapter analyzes the most effective tools with which U.S. presidents have pursued constitutional interpretation in seeking to legitimize their policies. Apart from defining the scope of presidential impact on the constitutionalization of politics, the chapter analyzes Donald Trump’s presidency and the tools he used to legitimize his actions and policies, as well as define the “appropriate” understanding of the Constitution.
