The article deals with the problem of locating the debtor’s centre of the main interests (COMI ) in case the debtor is a natural person. Firstly, the general rules that are provided in regulation 1346/2000 are discussed. The main body of the article is focused on how to locate COMI of the natural person with the division on those that are or are not conducting business activity. Finally, few judgments handed down by the courts of the EU Member States concerning COMI of natural persons are briefly described.
