Appearance of juridical act

Przedmiotem pracy jest pozorność czynności prawnej uregulowana w art. 83 k.c. Przepis znajduje się wśród wad oświadczenia woli, w związku z czym konieczne staje się rozważenie ich istoty i konsekwencji takiego umiejscowienia omawianego przepisu.Praca jest próbą zdefiniowania pozorności czynności prawnej i wskazania jej konstytutywnych cech. Analizie zostaje poddana czynność pozorna (nieważna) i czynność ukryta oraz przesłanki, które muszą zostać spełnione, żeby była ona ważna (zwłaszcza szczególnie istotna kwestia formy czynności prawnej). Rozważana jest także kwestia ochrony osób trzecich na gruncie art. 83 § 2 k.c. oraz szczególne problemy związane z pozornością – zwłaszcza pozorność w umowach o pracę.

The subject of this master's thesis is the appearance of juridical act which is regulated by article 83rd of civil code. This legal rule is situated among others concerning the defects in the delcaration of intent. Therefore it is necessary to consider their essence and a consequence of such locus of the discussed legal rule. This thesis is an attempt at defining the appearance of juridical act and indicating its constitutive features. Apparent (void) legal action and disguised legal action as well as the prerequsites which must be fulfilled in order to make it valid (especially the most significant question relative to the form of juridical act) are subject to the analysis.Last but not least, the matters under consideration are as follows: the protection of third parties on the strength of art. 83 § 2 civil code and particular problems related to the appearance - especially job contracts for false appearances' sake.
