Deposit as a legal instrument protecting the contracting authority.

Niniejsza praca jest poświęcona instytucji wadium w zamówieniach publicznych oraz analizie zagadnienia ochrony interesów zamawiającego w postępowaniu o udzielenie zamówienia publicznego przez ten instrument. W toku procedury zamawiający jest narażony na wiele niekorzystnych zachowań ze strony wykonawców ubiegających się o realizację zamówienia publicznego. Przed częścią z nich zamawiający jest chroniony za pomocą instytucji wadium wnoszonego w celu zabezpieczenia oferty. Podstawowymi celami wadium jest zdyscyplinowanie wykonawcy składającego ofertę do jej poprawnego przygotowania oraz podpisania umowy, w przypadku wybrania danej oferty jako najkorzystniejszej.Opracowanie omawia sposoby wnoszenia wadium, jego formy, zwrot oraz zatrzymanie wadium. Poszczególne elementy tego instrumentu prawnego są poddawane analizie pod kątem zabezpieczania interesów zamawiającego, ze szczególnym uwzględnieniem orzecznictwa dotyczącego sporych kwestii w obrębie omawianego instrumentu prawnego.

This work is focused on the institution of deposit in public procurement law and on the analysis of the issue of protecting the interests of the contracting authority by this instrument in the proceedings for awarding a public contract. During the procedure, the contracting authority is exposed to many negative behaviours. Some of the risk can be avoided by the deposit institution which secures the tender. The main functions of the deposit are the following: to discipline the economic operator to properly prepare the tender and to force him to sign the contract, if his tender has been selected.The paper discusses the methods of paying the deposit, its forms, returning and retaining the deposit. The specific components of this instrument are analyzed in terms of protecting the interests of the contracting authority with special focus on the contradicting cases regarding this legal instrument.
