Ethnic minority protection in Poland after 1989. Case study of Polish Tatars.

Celem niniejszej pracy jest analiza systemu ochrony praw mniejszości etnicznych w Polsce ze szczególnym wskazaniem na przypadek Tatarów polskich. Punktem wyjścia jest pytanie, jakimi narzędziami danymi przez państwo polskie mogą posługiwać się Tatarzy w celu zachowania i praktykowania swojej odrębności oraz jakie obowiązki ciążą na decydentach, których pozycja w systemie prawnym kraju wymaga obcowania z mniejszościami. Praca zawiera deskryptywną analizę uwarunkowań prawnych obowiązujących w Polsce, historii Tatarów oraz współczesnych form aktywności kulturalnej i religijnej praktykowanych w ramach mniejszości, a także o powiązania między wymienionymi elementami. Podstawowy materiał badawczy stanowią akty prawne regulujące prawa mniejszości etnicznych w Polsce, opracowania historyczne skupione na historii społeczności tatarskich na ziemiach polskich oraz publikacje wydawane przez organizacje zrzeszające Tatarów, w których zawarte są dogłębne opisy ich współczesnego życia religijnego i kulturowego. Wyniki analizy wskazują, że pomimo niewielkiej liczebności, Tatarzy aktywnie korzystają z uprawnień danym im przez polskich prawodawców i z intensywnością dbają o zachowanie swojego dziedzictwa w wymiarze jednostkowym oraz zbiorowym.

The aim of this thesis is to analyze the protection system for ethnic minority rights in Poland, with a particular focus on the case of Polish Tatars. The starting point is the question of what tools provided by the Polish state the Tatars can utilize to preserve and practice their distinctiveness, as well as what obligations rest upon decision-makers whose position within the country's legal framework requires interacting with minorities.The paper provides a descriptive analysis of the legal conditions in force in Poland, the history of the Tatars, and the contemporary forms of cultural and religious activities practiced within this minority, along with the interconnections between these elements.The primary research material consists of legal acts regulating the rights of ethnic minorities in Poland, historical studies focusing on the history of Tatar communities in Polish territories, and publications issued by Tatar organizations, which contain in-depth descriptions of their contemporary religious and cultural life.The results of the analysis indicate that, despite their small numbers, the Tatars actively exercise the rights granted to them by Polish legislators and intensively strive to preserve their heritage on both an individual and collective level.
