Stalking in criminological and legal terms

Stalking to niechciane powtarzające się zachowania wzbudzające w ofierze poczucie zagrożenia lub istotnie naruszające jej prywatność. Ze względu na charakter tego zjawiska niemożliwe jest przedstawienie wszystkich możliwych form działania stalkera, ale do najbardziej typowych zalicza się: nawracające telefony, smsy, śledzenie i kontrolowanie drugiej osoby. Ze względu na swoja złożoność stalking jest przedmiotem zainteresowania zarówno kryminologów, jak i prawników, którzy poprzez próbę scharakteryzowania zjawiska starają się opracować metody skutecznego reagowania. Stalking to tak istotne naruszenie wolności człowieka, że konieczne jest, aby wprowadzone przepisy umożliwiały skuteczne mu przeciwdziałanie.W pracy magisterskiej zawarte zostało wyjaśnienie terminu, opis sprawcy oraz ofiary, charakterystyka przepisów stosowanych do walki ze stalkingiem, uwagi prawnoporównawcze dotyczące uregulowań antystalkingowych w wybranych państwach oraz statystyki Policji i Ministerstwa Sprawiedliwości przedstawiające dane dotyczące zastosowania art. 190a kodeksu karnego na przestrzeni pierwszych 7 lat od wprowadzenia tego przepisu w Polsce.

Stalking is an unwanted repetitive behavior that causes a sense of threat or significantly compromises victim's privacy. Due to the nature of this phenomenon, it is impossible to present all possible forms of stalker operation, but the most typical are: recurring telephones, text messages, tracking and controlling the other person. Due to its complexity, stalking is of interest to both criminologists and lawyers who, through characterization, try to develop methods of effective response. Stalking is such a significant violation of human rights that it is necessary that the provisions introduced enable effective counteraction.This master’s dissertation includes an explanation of the term, description of the perpetrator and victim, characteristics of the rules used to combat stalking, comparative remarks about antistalking regulations in selected countries and statistics of the Police and the Ministry of Justice presenting data on the application of art. 190a of the Criminal Code over the first 7 years since the introduction of this provision in Poland.
