Judicial control of material and disposable acts of the parties in civil proceedings

Rozprawa ma na celu scharakteryzowanie czynności materialnodyspozytywnych stron – tj. zrzeczenia się roszczenia, uznania powództwa i zawarcia ugody. Każda z tych czynności została poddana analizie, uwzględniając charakter prawny danej czynności, jej istotę, granice czasowe, skutki oraz tryb postępowania. Część zasadniczą pracy stanowi zagadnienie kryteriów niedopuszczalności dokonania każdej z tych czynności oraz tryb kontroli sądowej. Jednocześnie ze względu na trwające prace nad nowelizacją ustawy procesowej, uwzględnione zostały propozycje autorów noweli dotyczące czynności będących przedmiotem niniejszej rozprawy.

The dissertation is aimed at characterizing material and disposable acts of the parties in civil proceedings - i.e. waiving the claim, recognition of the claim and reaching a settlement. Each of these acts has been analyzed, taking into account the legal nature of the act, time limits, effects and procedure. The main part of the work is the issue of the criteria of inadmissibility of each of these acts and the mode of judicial review. At the same time, due to the ongoing work on the amendment of the civil proceedings, the proposals of the authors of the novella regarding the acts being the subject of this dissertation were taken into account.
