Preventing and combating the exploitation of prostitution and other prostitution-related crimes - criminal and criminological aspects

Tematyka pracy magisterskiej dotyczy zapobiegania i zwalczania eksploatacji prostytucji i innych przestępstw okołoprostytucyjnych w odniesieniu do aspektów prawnokarnych i kryminologicznych. Rozważania dotyczą polskiego prawa karnego, jak i aktów prawa międzynarodowego na podstawie interdyscyplinarnego ujęcia problematyki z perspektywy prawnej, kryminologicznej, psychologicznej, pedagogicznej, socjalnej, jak i innych. Problem eksploatacji prostytucji wywołuje wiele kontrowersji zarówno w obszarze systemów regulowania prawnego prostytucji, jak i społecznego postrzegania zagadnienia. Ciekawym jest, że uprawianie prostytucji na podstawie polskiego prawa karnego nie podlega karze, choć inne przestępstwa okołoprostytucyjne są zabronione, w tym bardzo powszechny handel ludźmi w celu postytucyjnym. Dlatego też efektywna ochrona i przeciwdziałanie prostytucyjnym praktykom stanowią wyzwanie dla wielu instytucji. W Polsce obowiązuje system abolicjonistyczny, u którego podstaw znajdują się zdecydowany sprzeciw wobec eksploatacji prostytucji oraz założenia profilaktyczne w stosunku do tego zjawiska. Działania resocjalizacyjne podejmowane wśród osób prostytuujących się, jak i zaangażowanych w proceder w inny sposób, są bardzo istotne, aby zapobiegać wykorzystywaniu prostytucyjnemu. Odwołując się do literatury, orzecznictwa, regulacji prawnych, jak i danych statystycznych kwestia eksploatacji prostytucji wciąż zasługuje na uwagę i ulepszanie standardów zwalczania tego zjawiska.

The subject of the master's thesis concerns the prevention and combating of the exploitation of prostitution and other prostitution-related crimes in relation to the criminal and criminological aspects. The considerations concern Polish criminal law and acts of international law on the basis of an interdisciplinary approach to the issue from the legal, criminological, psychological, pedagogical, social and other perspectives. The problem of exploitation of prostitution causes a lot of controversy both in the area of legal regulation of prostitution and in the social perception of the issue. It is interesting that prostitution on the basis of the Polish criminal law is not punishable, although other prostitution-related crimes are prohibited, including the very common trafficking in human beings for the purpose of prostitution. Therefore, effective protection and counteracting the prostitution practices are a challenge for many institutions. In Poland, there is an abolitionist system based on a strong opposition to the exploitation of prostitution and prophylactic assumptions in relation to this phenomenon. Rehabilitation activities undertaken among prostitutes and those involved in prostitution in other ways are very important in order to prevent the exploitation of prostitution. Referring to the literature, jurisprudence, legal regulations and statistical data, the issue of the exploitation of prostitution still deserves attention and the improvement of standards of combating this phenomenon.
