Various aspects of the discontinuity principle of parliamentary work

Przedmiotem pracy licencjackiej jest problematyka zasady dyskontynuacji, która występuje w polskim porządku prawnym. W początkowej części pracy przedstawiono definicje omawianej zasady, wypracowaną przez doktrynę. W dalszych rozdziałach zarysowano wątek historyczny kształtowania się tejże zasady, zarówno w historii europejskiej jak i polskiej. Następnie autorka niniejszej pracy ukazuje obecne funkcjonowanie zasady dyskontynuacji w porządku prawnym. Przedstawiono poglądy doktryny, w której toczy się spór dotyczący tego jak traktować zasadę dyskontynuacji. Następnie ujęto sześć wyjątków od zastosowania zasady dyskontynuacji. Dodatkowo przedstawiono orzecznictwo Trybunału Konstytucyjnego. Ostatni punkt rozważań dotyczył wad i zalet stosowania zasady dyskontynuacji prac parlamentu w aspekcie ustawy budżetowej. Ujęto stanowiska aprobujące stosowanie dyskontynuacji w kontekście ustawy budżetowej oraz przeciwników jej występowania.

The subject of the bachelor's thesis is the issue of the principle of discontinuation, which occurs in the Polish legal order. In the initial part of the work, were presented the definitions of the discussed principle, developed by the doctrine. In the following chapters there is outlined the historical thread of the formation of this principle, both in European and Polish history. Next, the author of this work shows the current functioning of the principle of discontinuation in the legal order. Moreover, there are presented the views of the doctrine in which there is a dispute regarding how to treat the principle of discontinuation. Thereafter, there are included six exceptions to the application of the discontinuation principle, which were discussed. In addition, the jurisprudence of the Constitutional Tribunal was presented. The last point of consideration concerned the advantages and disadvantages of applying the principle discontinuity of parliamentary work in the aspect of the budget act. There has been included the positions approving the use of discontinuity principle in the context of the Budget Act and opponents of its occurrence.
