Niniejsza praca magisterska koncentruje się na analizie instytucji małżeństwa w kontekście prawa szariatu. Omawia zagadnienia takie jak zaręczyny, umowa małżeńska, tradycje ślubne, rolę kobiety w islamie, ideę poligamii czy pojęcie mahr bazując na różnych krajach muzułmańskich. Zostaje podniesiony również temat dziedziczenia według zasad prawa szariatu. Ponadto, praca porusza zagadnienie formalnego zakończenia związku małżeńskiego oraz związanych z nim procedur, takich jak okres idda, a także różne formy rozwodu m.in takie jak talaq. Praca ta stanowi przegląd tematu małżeństwa w prawie szariatu, akcentując różnice i podobieństwa w interpretacjach i praktykach obowiązujących w różnych regionach muzułmańskich. Celem niniejszej pracy było dostarczenie wiedzy oraz umożliwienie odbiorcy spojrzenia na instytucję małżeństwa w krajach islamu ze zrozumieniem i świadomością roli tradycji i religii, jako kluczowych czynników konstytuujących porządek prawny i praktykę dnia codziennego.

This master's thesis focuses on the analysis of the institution of marriage in the context of Sharia law. It discusses topics such as engagement, marriage contract, wedding traditions, the role of women in Islam, the concept of polygamy, and the notion of mahr based on various Muslim countries. It also addresses the issue of inheritance according to Sharia law principles. Furthermore, the thesis explores the formal termination of a marital relationship and related procedures, such as the idda period, as well as various forms of divorce, including talaq.This work provides an overview of the subject of marriage in Sharia law, emphasizing the differences and similarities in interpretations and practices prevailing in different Muslim regions. The aim of this thesis was to provide knowledge and enable the audience to understand the institution of marriage in Islamic countries with an awareness of the role of tradition and religion as key factors shaping the legal framework and daily life practices.
