The Limits of Patient Autonomy. Consent to medical treatment.

Praca magisterska porusza problematykę zgody pacjenta jako zdarzenia cywilnoprawnego,formy zgody, rodzajów zgody, a więc zgody właściwej, zastępczej,kumulatywnej oraz wadliwej. Wyjaśnia zagadnienie wyrażania zgody na zabieg medyczny przez pacjenta. Porusza kwestię sporną odpowiedzialnościza naruszenie dóbr osobistych pacjenta. Wskazuje, że problematykazgody na leczenie jest o tyle trudna, iż specyfikacja prawna w Polsce nie reguluje spornych kwestii, które w rzeczywistości najczęściej pojawiają się w relacji pacjent–lekarz. W pracy pojawia się problem zgody wyrażanej przez matkę nienarodzonego dziecka, a także przez pacjentów nieletnich.

This paper deals with issues of a patient’s consent, this consent understood in terms of a civil law event, consent forms, and consent kinds, i.e. proper, informed, proxy, or defective consent. The author hereof explains theissue of a patient’s giving consent to medical treatment. Touches upon the contentious issue of liability for any infringement of the patient’s personal interests. Points out that the problem concerning consent to treatment isdifficult to the extent that Polish legal provisions fail to regulate controversial issues that in fact are the most frequently occurring ones in the relationship between a patient and a doctor. I pay attention to the problem expressed by the mother of the unborn child as well as minors.
