The fall and massacre in Srebrenica in the context of international humanitarian law.

Praca "Upadek i masakra Srebrenicy w świetle międzynarodowego prawa humanitarnego" ma na celu prawną ocenę wydarzeń, jakie rozegrały się podczas konfliktu w Bośni i Hercegowinie w rejonie Srebrenicy. Autorka, opierając się na literaturze oraz wskazaniach Międzynarodowego Trybunału Karnego dla byłej Jugosławii, analizuje wydarzenia z lata 1995 r., pod kątem definicji ludobójstwa oraz zbrodni przeciwko ludzkości. Najwięcej miejsca, z uwagi na złożoność problemu, poświęcono zbrodni ludobójstwa, jej ujęciu w doktrynie oraz w społeczeństwie. Powyższe opracowanie obejmuje także wydarzenia sprzed upadku enklawy, skupiając się na działaniach zbrojnych i losie ludności cywilnej w rejonie Srebrenicy, ale także na roli społeczności międzynarodowej, w szczególności misji UNPROFOR w tym regionie. Praca przedstawia także miejsce tematu Srebrenicy w relacjach między stronami konfliktu oraz w społeczeństwie 18 lat od dokonania zbrodni.

The paper "The fall and massacre in Srebrenica in the context of international humanitarian law" aims to make a legal appraisal of the situation in the enclave of Srebrenica during the conflict in Bosnia and Hercegovina. The author, basing on the literature and findings of the International Criminal Tribunal for the Former Jugoslavia, analyses the summer 1995 events in the context of the definition of genocide and crimes against humanity. Special attention was focused on the genocide as a legal and social problem, because of the complex of this issue.The paper describes also the events which took place before the fall of the enclave. Attention is fixed on the military issues and the situation of the civilians in Srebrenica but as well on the role of the international community, especially UNPROFOR in this region.The author presents also the importance of the topic of Srebrenica for the parties of the conflict and society 18 years after the crime.
